(1) The compensation referred to in section 7 shall be determined in the following manner-
(a) In case of deduction of compensation under the Manjurinama, according to the same Manjurinama,
(b) If not in Manjurina, the government of Nepal will appoint a judge who is sitting or retired as an arbitrator and compensation will be given according to the decision of the arbitrator.
(2) Compensation for acquired property should be given as follows:-
(a) during the period of the acquisition, if the usufructuary of the acquired property had been under a contract, the same amount as would have been paid for the usufruct or tiro, and
(b) the loss to that property within the period of acquisition shall not be considered as natural loss due to customs or acts of God and  alteration made under the second chapter of section 5, and
(c) The cost of bringing the property to the condition it was in when it was acquired.
